New Rochelle Man Convicted of Gun Possession

NEW ROCHELLE, N.Y. – Demetrius Williams of New Rochelle left a loaded 9 mm pistol in a motor scooter that he returned to a local store, and now faces five to 15 years in state prison.

Williams was convicted after a jury trial of one count of second-degree criminal possession of a weapon, a class C felony, Westchester County District Attorney Janet DiFiore said Monday.

New Rochelle police responded to Yamaha Wheel Sports Center, 399 Huguenot St., about 4:12 p.m. May 6, 2011, on a report of a verbal dispute. The officers learned that the dispute was over nonpayment on a previous purchase of a motor scooter. A Yamaha employee and Williams agreed that until payment could be made, the scooter would remain at Yamaha, and the police left, DiFiore's office said.

A short time later, about 4:48 p.m., the police were contacted again by the Yamaha employee, who said that while inspecting the motor scooter returned by Williams, he saw what he believed to be a handgun in a locked compartment under the seat. Officers found a loaded, semiautomatic 9 mm handgun in the compartment.

Williams faces five to 15 years in state prison when he is sentenced on June 5.

Assistant District Attorney Brian Bendish of the Gang Violence and Firearms Bureau prosecuted the case.
