WESTCHESTER COUNTY, N.Y. - Police in Scarsdale busted a man from New Rochelle driving with a blood-alcohol content nearly triple the legal limit after he was spotted by officers driving into a curb.

Police conducting DWI traffic enforcement at approximately 4:30 a.m. on Sunday morning stopped 26-year-old Javier Contreras on Post Road after seeing him strike the curb while operating his Jeep Wrangler.

During the subsequent traffic stop, officers reported that Contreras stated he had several beers hours earlier at a bar in Mamaroneck. Officers noted that Contreras’ eyes were bloodshot and glassy, and there was a smell of alcohol on his breath.

Contreras proceeded to fail multiple Standardized Field Sobriety Tests and an alco-sensor prescreening test determined his blood alcohol content was .17 percent, more than double the legal limit. Once at Scarsdale Police Headquarters, a Datamaster DMT test determined that Contreras’ blood alcohol content was .21 percent, nearly triple the legal limit.

Police arrested Contreras and charged him with misdemeanor counts of driving while intoxicated and aggravated DWI for having a blood alcohol content greater than .18 percent. He was also cited for moving from his lane unsafely while driving. His vehicle was secured in the Scarsdale High School parking lot and he was released to a family member. Contreras is due back in court on Wednesday.
