The United Veterans Memorial and Patriotic Association had long been responsible for replacing the American flag at the city armory, but in March 2013 it also added a Gadsden flag, which is now associated with the tea party, LoHud.com reported.
The veterans organization said it flew the Gadsden flag for purely historical reasons, but the city took it down anyway. The judge ruled that since the flag was flown on a city flagpoll, it was government and not private speech, LoHud.com said.
